Terms of service

These terms apply to your use of this website and to services provided by Border Nexus, LLC (“we”, “us”). Each project is also governed by its own written scope and quote; if the two differ, the signed scope takes priority.

Using this website

You may browse this website and contact us for information about our services. Do not misuse the site, attempt to disrupt it or access it in ways it was not designed for.

Projects and quotes

• Work begins after you accept a written scope and fixed price.
• Changes outside the agreed scope are quoted separately and need your approval before they start.
• Payment stages are stated in each quote. Refunds and cancellations follow our refund & cancellation policy.

Ownership

Once paid in full, the custom code and content we create specifically for you belong to you. Third-party services, open-source components and our general-purpose tools remain under their own licences; where they are part of your system, you receive the rights needed to use it.

Hosted services

Where we host or operate software for you, such as a portal or messaging tool, you are responsible for how you and your staff use it, including complying with WhatsApp’s Business and Commerce policies and obtaining your customers’ consent to be contacted. We work to keep services available and secure but cannot guarantee uninterrupted operation, and third-party platforms (such as Meta or Cloudflare) may change or restrict their services.

Liability

To the extent permitted by law, our total liability for any claim relating to a project or service is limited to the amount you paid us for that project or service in the twelve months before the claim. We are not liable for indirect or consequential losses.

Governing law

These terms are governed by the laws of the State of Delaware, United States, unless a signed project scope says otherwise.
